1. Overview
Never Miss the Magic (“we”, “us”, “our”) operates the website nevermissthemagic.com and the MagicDates service (the “Service”). By creating an account or using the Service, you agree to these Terms of Service.
2. Description of Service
MagicDates monitors publicly available Disney Magic Key reservation availability data and sends notifications (via email and/or SMS) when dates you are watching become available. We do not make reservations on your behalf. You are responsible for completing any bookings through Disney’s official channels.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or overload the Service
- Share your account with others or resell access
- Interfere with the operation of the Service
6. Notifications & SMS
If you enable SMS alerts, you consent to receiving automated text messages at the phone number you provide. Message frequency depends on your watch configuration. Message and data rates may apply. You can opt out at any time by disabling SMS in your account settings or replying STOP to any message. See our SMS Terms for full details.
7. Subscriptions & Billing
Paid plans are billed on a recurring monthly basis. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months.
8. Disclaimer
The Service is provided “as is” without warranties of any kind. We do not guarantee the accuracy, timeliness, or completeness of availability data. Disney may change availability at any time without notice. We are not responsible for missed reservations or booking failures.
9. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Intellectual Property
All content and materials on the Service are owned by or licensed to Never Miss the Magic. Disney, Disneyland, Magic Key, and related marks are trademarks of The Walt Disney Company. We are not affiliated with or endorsed by The Walt Disney Company.
11. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Your continued use of the Service after such changes constitutes acceptance.
